Trimming dispute leads to tree-mendous neighbourhood fight

TOOWOOMBA is known as the Garden City, but it's pretty foliage can at times be the catalyst for neighbourhood disputes.

Such was the case when a Middle Ridge man went walking his dog on November 30 only for his neighbour of about 12 years to call out "Trim your trees ****!," Toowoomba Magistrates Court heard.

When the complainant man turned and replied "F*** off! I did trim my trees", his neighbour John Leo Connors approached him, repeating "Trim your trees, you ****."

He had then pushed an open hand into the man's face, causing a small abrasion, police prosecutor Nicola Prince told the court.

Connors had then walked back into his residence, but the complainant man had gone to police, the court heard.

Originally charged with assault occasioning bodily harm from the incident , the 49-year-old pleaded guilty in court to a reduced charge of common assault.

His solicitor Amber Acreman, of David Burns Lawyers, told the court her client instructed that the incident arose from an ongoing and lengthy dispute between the two neighbours.

However, it had been the first time her client had let his emotions boil over to such a point, she said.

Ms Acreman said her client instructed that during the incident the complainant man's dog had nipped her client on the finger.

Her client was married with adult children, had a good job and had no previous offences of a like nature, Ms Acreman submitted.

Magistrate Damian Carroll convicted and fined Connors $950.
