Man caught performing sex act in train station garden

A MAN was jailed after he was found performing a sex act on himself near Central train station in Brisbane, a Hervey Bay court heard.

Jonathon Christopher Pavletich pleaded guilty in Hervey Bay Magistrates Court to 14 charges including indecent acts in a public place; negligent acts harm; stealing; and failing to dispose of a syringe correctly.

Police prosecutor Sergeant Wayne Bushell said Pavletich failed to dispose of a syringe which later gave a Brisbane City Council worker a needle stick injury.

The court heard on October 29 last year a woman approached police at Central train station after she had seen a man pleasuring himself in the public garden.

Sgt Bushell said police could not find the man but a review of the CCTV footage showed Pavletich in the garden, publicly performing the sex act.

"He was crouching in the garden bed with his genitals hanging out of his pants," Sgt Bushell said.

The needle stick injury to the council officer happened a matter of days later.

Sgt Bushell said a council courier was attempting to move a discarded suitcase to the lost property area when a needle fell from the suitcase.

The council worker was pricked by the needle and has had to undergo a series of tests to ensure he had not contracted a communicable disease.

Other items in the suitcase showed the bag belonged to Pavletich.

Defence lawyer Justin Geldard said Pavletich had been suffering from substance abuse problems since he was a teenager.

Magistrate Graeme Tatnell sentenced Pavletich to 12 months jail with a parole release date after he served three.
