COURT action over Coffs Harbour City Council's refusal of a development application for a subdivision at North Emerald Beach has knocked off the table any possible move by the council to make an offer for the land.

The development application on low-lying land close to the beach was refused by the council on March 26.

Development of the site is opposed by a large group of Northern Beaches residents.

The developer, Paul Reid, said he had unsuccessfully put forward a number of proposals during his 20 year ownership of the site.

On April 23 the councillors approved a proposal by deputy mayor Sally Townley to begin preliminary investigations into the purchase of the property Lot 62 DP 1143405 at North Emerald Beach, which is owned by Pridel Investments Pty Ltd.

The following week the council was notified of an appeal by Pridel against its refusal of the DA.

The councillors are now being advised to adopt a completely hands-off approach to the property in the interests of good governance, until the legal appeal has completely run its course.

This is because the council, currently the determining authority and also now the defendant against the appeal, would then be wearing a third hat, that of a prospective buyer
