Chef told to ride a push-bike to work after police bust

A CHEF has been told to buy a bike and ride it to work after the man was caught drug driving on the Dawson Hwy.

Cody James Mckillop pleaded guilty in Gladstone Magistrates Court to one count of driving while a drug was present in his system while on a provisional licence.

The 28-year-old was intercepted on March 3, 2019 at Kin Kora for a roadside drug test.

The test returned positive results to methamphetamines.

Police prosecutor Senior Constable Balan Selvadurai said given Mckillop's history a three to six month jail term with immediate parole would be in range.

"He put the community at risk," Sen-Constable Selvadurai said.

Defence lawyer Rio Ramos her client was a chef by trade and a father.

Ms Ramos said Mckillop had not taken any drugs for four months before being pulled over by police.

"He will need to buy a bike to get to work," Ms Ramos said.

Magistrate Dennis Kinsella said: "well, he will get fit, won't he?"

Looking at Mckillop's criminal history Mr Kinsella said he was doing a drug drive each year.

"One in 2017, one in 2018 and now 2019...He is just not getting it," Mr Kinsella said.

Ms Ramos asked for the minimal licence disqualification period, given Mckillop had a job and duties to his family.

Mr Kinsella shook his head.

"Ms Ramos, there has to be a sting in the tail," he said.

Mr Kinsella said he understood the man had things to do but the community's safety was his first priority.

"He has had two previous convictions," Mr Kinsella said.

Mr Kinsella ordered Mckillop to complete a 12-month probation order and disqualified him from driving for six months.

A conviction was recorded.
