AN Italian lawyer is suing an airline for $8173 because he had to sit next to an overweight person on a flight from Cape Town to Dubai.

Giorgio Destro claims the heavy-set man in the seat next to him ruined his nine-hour flight.

He is also angry that Emirates refused to let him change seats.

Mr Destro, an Emirates "gold member", apparently paid about $1100 for the seat, various media outlets reported.

"For nine hours, I had to stand in the aisle, sit on seats reserved for the cabin crew when they were free, and in the final phase of flight resign myself to suffer the spillover of the passenger at my side," he told reporters.
